We reserve the right to change these terms and conditions at any time. Any changes will take effect when posted on the website and dated in the header notes. It is your responsibility to read the terms and conditions on each occasion you use this website and your continued use of the website shall signify your acceptance to be bound by the latest terms and conditions. If you are not a consumer, you confirm that you have authority to bind any business on whose behalf you use this website.

Website terms and conditions

The Amanda Hamilton website can be used without registering as a subscriber, but by accessing any part of the site you agree to be bound by these Terms & Conditions. Our Terms and Conditions do not affect your statutory rights. 

Subscription 

When you subscribe to our website, you must ensure that your details are accurate and correct. You can amend your personal details at any time during your membership in the Profile area of the account. 

Billing 

Our membership is automatically billed every month after your initial package period, unless your initial package is part of a specific promotion. The details of our pricing are made clear in the registration process. 

When you first register we will ask you to provide credit/debit card details and, depending on package chosen, you will be charged your initial membership fee on chosen package. At the end of your chosen package period, you will be billed monthly in advance for your subscription fee.

Our prices include the prevailing UK VAT rate.  

Cancellation

Your subscription will renew automatically unless you elect for it to be cancelled. You can cancel your subscription at any time outwith the initial package period subject to 28 days notice. 

If you cancel within 7 days of initial registration, we will refund you your membership less 5% to cover billing costs. If you cancel 7 or more days after registration, we will cancel your account at the end of the initial membership period.

Should you want to cancel but forget, contact us and we will refund the inactive period of subscription from this point to the point at which you last logged in.

Orders

a) All orders that you place on this website will be subject to acceptance in accordance with these terms and conditions.

b) The 'confirmation' stage sets out the final details of your order. You will be viewing this in a secure server screen. When you place your order you will be sent an automatic confirmation email.

c) Acceptance of your order and the completion of the contract between you and us will take place on electronic dispatch to you of the products ordered unless we have notified you that we do not accept your order or you have cancelled it. Please see Returns and Refunds section.

d) We file details of your order for you to subsequently access via this website. Please print out these terms and conditions and the order confirmation for your own records. You will need the 'order reference number' on the 'order confirmation' for any correspondences with us regarding your order.

Payment 

a) We require full payment at the time we receive your registration and/or product order in all cases where the product is ready for dispatch.

b) The price you pay is the price displayed in the website-shopping basket at the time we receive your order. While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

c) Payment can be made by credit card or debit card.

d) All card details are entered on a Secure Server provided by a Certified E-Commerce provider. Card and personal information is then encrypted. No unencrypted information is kept on the Secure Server or Amanda Hamilton Weight Loss Limited computers. All card details are destroyed once an order is processed. Goods will not be sent until payment is received in full.

e) All prices include VAT (where applicable) and bank card charges at the applicable current rates. VAT will be deducted at time of process for those areas that are VAT exempt.

Liability

We will take all reasonable precautions to keep the details of your order and payment secure, but unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you. Data is not provided or shared with any other third party other than the specified delivery address, all information is held within Amanda Hamilton Limited for internal use only.

Contract

a) The laws of Scotland shall govern the contract between us and any dispute between us will be resolved exclusively in the courts of Scotland. English is the only language offered for the conclusion of the contract.

b) Amanda Hamilton Weight Loss Limited shall be under no liability for any delay or failure to deliver products or otherwise perform any obligation as specified in these terms and conditions if the same is wholly or partly caused whether directly or indirectly by circumstances beyond its reasonable control.

c) These terms and conditions including the documents or other sources referred to in these terms and conditions supersede all prior representations.

d) Understandings and agreements between you and Amanda Hamilton Weight Loss Limited relating to the use of this website (including the order of products) and sets forth the entire agreement and understanding between you and Amanda Hamilton Weight Loss Limited for your use of this website.

Distance Selling Regulations

a) Distance Selling Regulations expect you to have made sufficient enquiry to make an informed purchase.

b) You are encouraged to discuss your intended purchase should you require any additional information that leads you to making an informed purchase.

c) Your right to cancel your order does not apply to items personalised or made to your specification.

d) Should you decide to return your purchase for a refund or exchange you are required to take all reasonable care of that purchase and return it intact, unused in merchantable packaging.
